Terms of service

The purchasers of products and/or services from SpectraPure.com or any affiliate thereof ("SpectraPure.com") are subject to the following terms and conditions. The term "Purchaser" shall mean the party placing an order with SpectraPure.com and identified as such in any document attached hereto ("attachment"), this document and all attachments are hereinafter referred to as "this Agreement". The terms and conditions set forth in this agreement shall constitute the entire agreement between SpectraPure.com and Purchaser relating to the sale of the products ("Products") and/or services ("Services") described in any attachment, or in an subsequent purchase or sales order. No conflicting or final terms or conditions which may appear in any order or other document of Purchaser shall be of any force or effect unless accepted and agreed to in writing by an officer of SpectraPure.com.

RESPONSIBLE PRACTICES:

Customer will (i) familiarize themselves with product literature or information SpectraPure, Inc. provides (also refer to updated materials and references on web site: www.spectrapure.com) (ii) follow safe handling, use, selling, storage, transportation, and disposal practices, including special practices as Customer’s use of the goods require, and instruct its employees, contractors, agents and customers in these practices, and (iii) take appropriate action to avoid spills or other dangers to persons, property or the environment. Customer will indemnify SpectraPure, Inc. for all claims, damages and related costs, including reasonable attorney fees arising out of Customer’s noncompliance with any of its commitments under this paragraph.

ALL WATER SYSTEMS SHOULD BE MONITORED FOR POTENTIAL LEAKS FOR A PERIOD NOT LESS THAN 72 HOURS UPON INSTALLATION TO VERIFY PROPER LEAK-FREE OPERATION.

Price

The prices under this agreement are F.O.B. point of shipment and exclusive of all sales, use, excise or other taxes. The prices set forth shall be in effect until notice in writing from SpectraPure.com., Inc. SpectraPure.com reserves the right to adjust prices at its discretion with proper notice to Purchaser. In the event a product listed on our website is labeled with an incorrect price due to some typographical, informational, technical or other error, SpectraPure.com shall at its sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information.

Taxes

Purchaser shall pay all federal, state, municipal or other sales, use, excise or other taxes, assessments and charges assessed or levied against the products and/or services. Purchaser agrees to pay to SpectraPure.com on request any federal, state, municipal or other sales, use, excise or other taxes, assessments or charges payable by SpectraPure.com with respect to the products and/or services of the sale thereof.

Delivery

Delivery will be F.O.B. point of shipment. Unless otherwise arranged, Purchaser will select and pay for the shipping speed they prefer during Checkout on SpectraPure.com, and must cover all shipping and handling charges, including any additional taxes and fees incurred. Purchaser assumes all risk of loss during delivery of the Products by SpectraPure.com to the carrier. In the absence of instructions to the contrary, SpectraPure.com, on behalf of the Purchaser, shall exercise its own discretion as to the method of shipment to be used and the selection of the carrier but shall not be deemed thereby to assume any liability in connection with the shipment nor shall the carrier thereby be deemed an agent of SpectraPure.com. No goods shall be returned for credit or replacement without prior RMA authorization by SpectraPure.com. All goods returned without such prior authorization will not be accepted by SpectraPure.com and will be returned to the purchaser freight collect.

Date of shipment or delivery projected at any time prior to the actual shipment is based on our best judgement, and is subject to change. The Shipment Date that is given may be changed by Spectrapure, Inc. on account of circumstance both internally and/or externally that are outside of Spectrapure, Inc.'s reasonable control. Under no circumstances will SpectraPure, Inc. assume responsibility for any damages or claims resulting from delays in delivery or missing deliveries. SpectraPure, Inc. assumes no responsibility for shipping delays experienced by it's 3rd Party Carriers (USPS, UPS, Fedex, etc.) or their associations. Please contact your selected Carrier directly for any delayed or missing packages.

Terms of Payment

Except as otherwise stated in any attachment, terms are net due upon purchase. Payment method will be credit card (Visa, MasterCard, American Express or Discover). Checks are accepted subject to collection and the date of collection shall be deemed the date of payment. Any check received from Buyer may be applied by Seller against any obligation owing from Buyer to Seller, regardless of any statement appearing on or referring to such check, without discharging Buyer's liability for any additional amounts owing from Buyer to Seller, and the acceptance by Seller of such check shall not constitute a waiver of Seller's right to pursue the collection of any remaining balance. Buyer shall pay interest on any invoice not paid when due from the due date to the date of payment at the rate of one and one-half (1–1/2%) percent per month or such lower rate as may be the maximum allowable by law. If Buyer fails to make payment when due, Seller may pursue any legal or equitable remedies, in which event Seller shall be entitled to reimbursement for costs of collection and reasonable attorney’s fees. There shall be no time limit as to when Seller shall pursue any legal or equitable remedies. Reasonable annual costs of collection and attorney fees shall be defined as the greater of a maximum of $50,000, one hundred percent (100%) of compounded collection amount, or maximum allowable by law.

SMS/MMS Mobile Message Marketing Program Terms And Conditions

SpectraPure (“We,” “Us,” “Our”) is offering a mobile messaging program (the “Program”), which you agree to use and participate in subject to these SMS/MMS Mobile Messaging Terms and Conditions, Our Terms of Use, Privacy Policy, and any other applicable terms and agreements related to your use of Our Program (the “Agreement”). By opting in to or participating in Our Program, you accept and agree to these terms and conditions, including, without limitation, your agreement to resolve any disputes with Us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below. This Agreement is limited to the Program and is not intended to modify other agreements that may govern the relationship between you and Us in other contexts.

Program Description: Without limiting the scope of the program, users that opt in to the program can expect to receive messages from us and others texting on our behalf concerning the marketing and sale of our goods, services, and events. Messages may include checkout reminders.

User Opt In: The Program allows users to receive SMS/MMS mobile messages by affirmatively opting into the Program, such as through checking the box to sign up online or application-based enrollment forms. Regardless of the opt-in method you utilized to join the Program, you agree that this Agreement applies to your participation in the Program. By participating in the Program, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in, and you understand that consent is not required to make any purchase from us. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an automatic telephone dialing system as defined by the Telephone Consumer Protection Act.

Message Cost and Frequency: Message and data rates may apply for each message sent or received in connection with Our Program. It is best to contact your wireless provider if you have questions regarding your data or text plan.  Message frequency varies. The Program involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with us.

Support Instructions: For support regarding the Program, text “HELP” to the number you received messages from or email Us at retail@spectrapure.com. Please note that requests to this email address is not an acceptable method of opting out of the program. Opt outs must be submitted in accordance with the procedures set forth above.
